Welcome to Check My Roof, an online software service ("the Service"). By accessing or using checkmyroof.ai you agree to these Terms of Service. If you do not agree, do not use the Service.

1. Who we are

Check My Roof is operated by the founder of Cutting Edge Construction, a licensed California roofing contractor (CSLB License #1007180). The CSLB license appears on this Service as biographical information about the founder's professional credentials. The Service itself is a software product, not a roofing service or construction contract. Nothing on this Service constitutes an offer to perform construction work outside of Cutting Edge's licensed service area.

2. THE SERVICE IS NOT LEGAL, INSURANCE, OR PROFESSIONAL ADVICE

THE SERVICE PROVIDES INFORMATIONAL CONTENT ONLY. IT DOES NOT PROVIDE LEGAL ADVICE, INSURANCE ADVICE, PUBLIC-ADJUSTING SERVICES, OR ANY OTHER LICENSED PROFESSIONAL ADVICE.

The Service is not a law firm and not a public adjuster. We do not represent you in any insurance claim, negotiation, dispute, or legal matter. Any document templates, code citations, or pricing references produced by the Service are provided for your educational reference only. You alone are responsible for any decision you make based on information from the Service.

You should consult your insurance policy, a licensed public adjuster, or a licensed attorney before relying on any output from the Service for an insurance claim or legal matter.

3. Document templates and supplement correspondence

When the Service produces a document template (sometimes called a "supplement letter"), that document is your document, in your name. The Service is a software tool that helps you generate a document; it is not an agent acting on your behalf. You are solely responsible for the contents, the decision to send it, and any consequences. You may modify, rewrite, ignore, or never send the document as you choose.

4. Code citations and pricing data

Code citations referenced in the Service (International Residential Code sections, manufacturer warranty documents, regional pricing benchmarks) are based on publicly available reference materials at the time the Service was built. Local code amendments, supersedence, and pricing fluctuation may produce different results in your specific jurisdiction or market. Verify all citations against the controlling code, warranty document, or pricing source for your location before acting on them.

5. Payments, refunds, subscriptions

Payments are processed by Stripe, Inc. The Service does not store your full card number. Refund terms are described in our Refund Policy. Subscriptions auto-renew until you cancel from your billing portal.

6. User content and your data

You retain ownership of content you submit (addresses, photos, estimates). You grant us a limited, non-exclusive license to process that content for the purpose of providing the Service to you. We do not sell your personal data. See our Privacy Policy.

7. NO WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL PRODUCE ANY SPECIFIC RESULT, RECOVERY, REIMBURSEMENT, OR OUTCOME IN ANY INSURANCE CLAIM OR DISPUTE.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOST PROFITS, LOST CLAIMS, LOST OPPORTUNITIES, OR DENIED REIMBURSEMENTS. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You agree to indemnify and hold harmless Check My Roof, its operators, contractors, affiliates, and employees from any claim, loss, liability, or expense (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, your violation of any law, or your submission of content that infringes the rights of any third party.

10. Binding arbitration; class action waiver

Any dispute between you and Check My Roof arising from or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Sacramento County, California, or remotely by mutual agreement. You and we both waive any right to a jury trial.

You and we agree that each may bring claims against the other only on an individual basis, not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. Notwithstanding the foregoing, either party may bring an individual claim in small-claims court for disputes within its jurisdictional limit.

We may update these Terms at any time. Material changes will be announced on the Service or by email. Your continued use after changes constitutes acceptance.

13. Governing law and venue

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Subject to the arbitration clause above, any judicial action shall be filed in the state or federal courts located in Sacramento County, California, and you consent to that exclusive venue.

14. Entire agreement; severability

These Terms, together with the Refund Policy, Privacy Policy, and Disclaimers, constitute the entire agreement between you and Check My Roof regarding the Service. If any provision is held unenforceable, the remainder shall remain in full force.
